Welcome to SanitizeEmail.com (the “Service”), operated by SanitizeEmail (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of the Service. By using or accessing the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Definitions & Acceptance
Service: Email validation, list-cleaning, and related features including bulk validation, real-time validation, disposable-email detection, API access, and result export.
User: Any individual or entity who uses or subscribes to the Service.
By creating an account or using the Service, you confirm that you are at least 18 years old and legally authorised to enter into a binding agreement.
2. Account Use & Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.
You agree to use the Service only for lawful and legitimate purposes and in compliance with all applicable laws and regulations.
3. Services and Acceptable Use
Services Provided:
- Bulk email-list validation
- Real-time email validation
- Disposable-address detection
- Advanced checks (SMTP, MX, DMARC)
- API integration
- Export of results (CSV, Excel, JSON)
You must not use the Service for spam, unsolicited marketing, fraud, harassment, or any malicious or illegal activities. Abuse or misuse may result in immediate termination of your account.
4. Payment, Billing & Subscription
The Service is offered through subscription plans or other plan types as listed on our Pricing page.
By subscribing, you authorise us to charge the payment method you provide. Billing and renewals follow the schedule defined in your selected plan.
You may cancel at any time. Cancellation stops future billing but does not entitle you to a refund for the current billing period.
5. Refunds
Refunds are provided solely under the conditions described in our Refund Policy.
6. Data Ownership & User Data
You retain ownership of all data you upload, including email lists and contact data.
We process your data only for the purpose of providing the Service and do not claim ownership over your data.
We commit to safeguarding your data using reasonable technical and organizational measures - but you acknowledge no system is perfectly secure.
7. Intellectual Property
All software, algorithms, trademarks, branding, and content provided under the Service remain our property or are licensed to us.
By using the Service, you grant us a limited license to process your data for validation and operations.
8. Disclaimers & Limitation of Liability
The Service is provided “as is” without warranties of any kind, whether express or implied.
We do not guarantee uninterrupted, error-free, or fully accurate results.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, lost profits or goodwill, loss of data, or other losses arising from your use of the Service.
9. Indemnification
You agree to indemnify and hold harmless SanitizeEmail, its affiliates, officers, employees, and agents from any claim or liability - including reasonable attorneys’ fees - arising out of your misuse of the Service, violation of these Terms, or infringement upon the rights of any third party.
10. Termination
We reserve the right to suspend or terminate your account at any time for any breach of these Terms or if required by law.
Upon termination, we may delete or anonymize your data in accordance with our Privacy Policy and applicable legal requirements.
11. Modifications to Terms
We may update or revise these Terms at any time. Material changes will be notified by email or via a notice on our website.
Continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Nepal.
Disputes arising under or related to these Terms will be resolved in the courts of Nepal or through binding arbitration as described herein.
13. Force Majeure & Other Provisions
We are not liable for failure to perform due to causes beyond our reasonable control (e.g., natural disasters, network failures, third-party outages). If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
